Program Overview:
With the implementation of the Requirements of Participation (RoPs) and the new survey process, providers are experiencing an increase in the number of deficiencies in both standard and complaint surveys. The Informal Dispute Resolution process (IDR), Independent Informal Dispute Resolution process (IIDR) and Appeals to an Administrative Law Judge are the only recourse providers have to dispute citations of federal deficiencies. Being successful in the IDR, IIDR and/or Appeals process can have a multi-year impact on a provider’s future fines and sanctions and on the public presence of citations on Nursing Home Compare. In addition, there are other consequences a provider may face due to deficiency citations.
However, many providers are unfamiliar with the IDR, IIDR and Appeals processes, including what can be disputed and/or appealed, what the process is to dispute and/or appeal and how to do this effectively. This seminar will include an overview of the IDR, IIDR and Appeals process as well as tips to develop IDR, IIDRs and Appeals to effectively dispute deficiency citations.

Michelle Auger, Corporate Informatics Nurse for Essex Group Management Corporation. Michelle has extensive experience writing successful IDR and IIDR requests as well as Appeals for her company’s skilled nursing facilities.
William Bogdanovich, President/CEO at Broad Reach Rehabilitation and Skilled Care at Liberty Commons. Bill was involved with the initial pilot IDR process and serves on the IDR and IIDR panel representing the provider community.
Anthony Cichello , partner at Krokidas & Bluestein LLP. His practice focuses on regulatory, compliance and litigation matters for individual and corporate clients in the health and human service fields.
